Special warranty conditions
for a used machine or part


Applicable from 01/03/2025


As a matter of principle, we do not grant any warranty.
If a warranty is agreed, it must be expressly mentioned on a quotation or warranty certificate issued by our company and signed in advance by our management.


Purpose of the warranty:
This “Warranty” is a commercial warranty.
This warranty cannot be combined with the manufacturer's warranty. If a manufacturer's warranty is applicable, the customer must give priority to the manufacturer's warranty.
This Guarantee is distinct from the legal guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code.
This warranty is intended to cover mechanical failures affecting the machine and/or the part sold, i.e. any fortuitous failure of a guaranteed mechanical part or component attributable to an internal cause other than normal wear and tear or deterioration, negligence on the part of the beneficiary of the warranty or an external event.
The conditions detailed below specify the particular conditions of the Warranty, the terms of its implementation, its duration, its territorial scope and the designation of the guarantor.
Other warranty conditions are detailed on the warranty certificate issued by our company.

 

Warranty duration and scope:
The Warranty applies only to machines and parts sold and located in Metropolitan France.
The Warranty takes effect from the date of delivery of the goods to the customer.
Any intervention under the Warranty shall not have the effect of extending its duration.
THE WARRANTY APPLIES ONLY TO PARTS RECOGNIZED AS DEFECTIVE BY OUR WORKSHOP, TO THE EXCLUSION OF ANY OTHER DAMAGE, MATERIAL OR IMMATERIAL, WHETHER CONSEQUENTIAL OR NOT, INCLUDING BUT NOT LIMITED TO FINANCIAL OR COMMERCIAL LOSS, LOSS OF PROFIT, OPERATING LOSS, LOSS OF ORDERS, LOSS OF OPPORTUNITY OR LOSS OF CUSTOMERS, AS WELL AS ANY ACTION BROUGHT AGAINST YOU BY A THIRD PARTY. You will not be entitled to any compensation in the event of machine immobilization due to the application of the Warranty.

For used machines: as specified in the special warranty conditions, only mechanical failures originating from the components listed below are covered by the Warranty:

  • Fuel supply: all engine equipment contributing to air intake and fuel supply.
  • Gearbox: mechanical or automatic gearbox.
  • Bodywork and shielding: all parts enabling the opening mechanisms to operate under normal safety conditions.
  • Air-conditioning: heating and refrigeration appliances and controls for their use.
  • Steering: all component parts of the steering system, including the power-assist system, steering control and transmission to the steered wheels.
  • Exhaust: exhaust pipes, turbocharger, manifold and silencers.
  • Electricity: all electrical parts, conductors, switchgear, generator, switches.
  • Electronics: accessories contributing to engine operation, on-board equipment, comfort accessories (radio). Not covered: alarm, computer, telecommunications and radio guidance systems.
  • Engine: all engine parts and accessories.
  • Suspension: all ground connection parts and shock absorbers.
  • Braking system: brake components and controls, plus all accessories except friction parts, pads and linings.
  • Transmission: parts transmitting motion from the engine to the drive wheels: shafts, axles, universal joints.
  • Driveline: the chain of parts enabling the equipment to move forward: engine, gearbox and axle. Ground engaging tools and equipment connected to auxiliary lines are excluded.
  • Work kinematic chain: the chain of parts enabling the equipment to be used in tool function: motor, pump, distributor, cylinder. Ground engaging tools and equipment connected to auxiliary lines are excluded.
  • Machine driveline: heat engine, gearbox, translation gearbox, rotation gearbox, main hydraulic pump, axles.

For used parts:
For used parts, only the “Level 2 Warranty” mentioned on the quotation or warranty certificate grants the present commercial warranty.
If the item sold, whether used equipment or parts, is covered by a commercial warranty, this warranty applies only to the items mentioned and for a period of six 6 months from delivery, with the exception of transmission components (i.e. gearbox, transfer case, axle), for which the warranty period is 12 months from delivery.


In all cases, unless otherwise specified in the specific warranty conditions:
THE WARRANTY DOES NOT COVER:
       DISMANTLING AND TROUBLESHOOTING COSTS
       LABOR COSTS
       REASSEMBLY COSTS
       TRAVEL EXPENSES FOR OUR TECHNICIANS*.
       TRANSPORT, REMOVAL AND/OR TOWING COSTS
*Where the special conditions state that travel costs are covered, these are included WITHIN THE LIMIT OF 200 KM. Beyond this limit, travel costs will be invoiced at the rate in effect at the time of travel.

 

Warranty exclusions:


The following are excluded from the Warranty:

  • Wear parts such as:
    • brake discs and pads, seals and guides, bearings, filtration, hoses
    • belts, chains, rubber rollers
    • dry clutch mechanism
    • hydraulic sockets, electrical sockets, batteries, resistors and fuses
    • all exhaust pipes
    • windows, mirrors, windscreens, rear-view mirrors, rotating beacons, bulbs, lamps, lights, windscreen wipers
  • Consumables including :
    • liquids or fluids of any kind contained in casings, tanks or reservoirs.
    • hydraulic shock absorbers and accumulators, dampers and flectors, rubber buffers, springs,
    • rubber or steel tires and tracks, rubber belts and steel rollers, sprockets, idler wheels and their tensioning systems;
    • goods and equipment towed, hauled or carried,
    • bodywork, seals, locks, keys, paints and coatings
    • gas struts, seats.
    • Wear blades and bucket teeth
    • Accessories such as buckets
  • Cosmetic damage, scratches and chips.
  • Damage to alarms, computer systems, telecommunications and optional radio guidance systems.
  • All accessories fitted after the sale of the machine and, more generally, not fitted by our company.

However, the parts referred to above are guaranteed when the damage to these parts is the result of a failure affecting other parts covered by the Warranty.


IN GENERAL, DEFECTS CAUSED BY: (1) NORMAL WEAR AND TEAR OF THE PRODUCT, IN PARTICULAR OF WEARING PARTS; (2) USE OF THE PRODUCT FOR PURPOSES OTHER THAN THOSE FOR WHICH IT IS INTENDED, OR FOR PURPOSES OTHER THAN THOSE RECOMMENDED BY THE MANUFACTURER, THE COMPANY AND/OR APPLICABLE REGULATIONS; (3) NEGLIGENCE OR LACK OF SUPERVISION ON THE PART OF THE USER, IN PARTICULAR ANY PREMATURE DETERIORATION NOT NOTIFIED TO THE COMPANY IN GOOD TIME; (4) FAILURE TO MAINTAIN THE PRODUCT; (5) WORK CARRIED OUT BY UNQUALIFIED PERSONNEL; (6) EVENTS EXTERNAL TO THE PRODUCT ITSELF (THEFT, VANDALISM, MALEVOLENCE, SHOCK, FLOOD, FIRE, TRANSPORT, EXCESS COLD OR HEAT, IMMERSION, ETC.); (7) UNAUTHORIZED MODIFICATIONS TO THE PRODUCT OR ITS COMPONENTS. ); (7) NON-CONFORMING MODIFICATIONS MADE TO THE PRODUCT BY THIRD PARTIES OR THE USER HIMSELF.
ANY WARRANTY CLAIM IS ALSO EXCLUDED IF THE CUSTOMER REFUSES TO ALLOW THE COMPANY ACCESS TO THE PRODUCT FOR MAINTENANCE, INSPECTION, REPAIR AND/OR APPRAISAL PURPOSES.

It is specified that “normal wear and tear” is characterized by the comparison between the observed condition of damaged parts, their determined period of use and the average operating potential usually attributed to them. If necessary, this will be assessed by an expert appointed by our company.

 

Warranty conditions:


Maintenance obligation
For the Warranty to be valid, the machine must be used, serviced and maintained for the duration of the Warranty in accordance with its intended use and in compliance with the manufacturer's recommendations and applicable regulations. The customer must be able to provide proof of this, including invoices. In particular, the customer shall regularly check fluid levels and quality, and act in accordance with warning or emergency lights or messages.


Expert appraisal
To be valid, all requests must be made in writing, preferably by registered letter or verbally against receipt, and addressed to our company's head office during the period of application of the Guarantee, date of receipt of the letter being taken as proof. The following information must be provided: machine make, model and serial number, number of hours on the day of the claim, location and circumstances of the claim.
Our company will only accept responsibility for the machine after an expert appraisal has been carried out by one of our technicians or a third party appointed by our company. The machine must be easily accessible.

 

Conservatory measures
No makeshift or provisional repairs may be carried out prior to an expert appraisal. Repairs not approved by our company will not be covered. Please note that authorization to proceed with repairs does not oblige us to take responsibility for the loss if subsequent observations show that it is not covered under the terms of the Guarantee.
Generally speaking, you must take all measures to reduce the cost of the claim and provide our company with all the information necessary to establish the damage and determine its amount.
In particular, any parts damaged or requiring replacement will be kept at our disposal.

Misrepresentation
If, in bad faith, you make false declarations, conceal or subtract all or part of the goods in question or parts that could facilitate the assessment of the damage, exaggerate the amount thereof, fail to declare the existence of other insurance covering the same risks, use inaccurate documents as justification or use fraudulent means, you will automatically forfeit all rights under the Guarantee.

 

Conditions of repair or replacement of the defective part:

Warranty
In the event of a warranty claim, all work must be carried out by our company or by a third party appointed by our company.

Solution implemented
If the Warranty applies, our company will decide whether to replace or repair the defective part. In the event of replacement, the defective part may be replaced by a part of equivalent quality, in particular a second-hand or repaired part. If replacement or repair is not possible, particularly if it proves too costly, the sale may be rescinded, without any compensation being payable by our company; this decision remains at the discretion of our company.

Financial limits
In the event of repair or replacement, the deductible mentioned in the special warranty conditions will be taken into account, if applicable. In addition, the amount of costs incurred by our company under the Guarantee may not exceed the market value of the machine in question on the date of the claim, as determined by an expert appointed by our company. If you do not wish to carry out the proposed repairs, you will not be entitled to any compensation.

Disputes - Expert appraisal
In the event of a dispute, particularly concerning the amount of repair work, you agree that our company may appoint an expert to resolve the dispute. You undertake to facilitate the expert's investigations and accept that the expert's conclusions and assessment of the cost of the work will be binding on you.

Operating data
Within the scope of this Warranty, you expressly authorize us or any third party appointed by us to read the product's operating data (e.g. operating hours, surface treated, duration of use) and to access the telematic data documentation. Access to this data is permitted for as long as and to the extent necessary to fulfill the Warranty and/or safeguard the legitimate interests of our company.

 

Causes for termination of the Guarantee


The Guarantee constitutes a contract.
We reserve the right to terminate this contract or reduce the Warranty, without compensation to you, in the event of:
- Non-compliance with your obligations under the Warranty, in particular the maintenance obligation.
- concealment, omission, intentional misrepresentation or inaccuracy concerning a declared claim;
- non-payment of debts owed to our company, whether or not these debts are related to the object of the Guarantee.

 

Transfer of the Guarantee
In the event of sale of the machine, the warranty is not transferred to the new purchaser.
